Em alguma medida a minha reflexão essa hora da manhã vendo o voto do Ministro Luiz Fux, é que sistema de “Freios e Contrapesos” célebre em toda Ciência Política Ocidental, se observa no Brasil, com o Legislativo agindo habitualmente como um freio, e o Judiciário como um contrapeso. Enfraquecendo muito mais ainda o papel do Executivo, onde já se alega historicamente no Brasil, que teve uma Constituição em 1988 pensada para ser Parlamentarista, e se tornou por vontade soberana do povo Presidencialista, onde sempre escutamos que o Congresso Nacional é extremamente incomodo e super empoderado, em relação ao Executivo. Entendido contrapeso, com uma observação até curiosa, por exemplo, os Tribunais de Contas são órgãos anexo do Legislativo, o Ministério Público também anexo ao Executivo, e o Judiciário se não anexo de coisa alguma, mas tendo seus Ministros indicados pelo Executivo, é propriamente o contrapeso. Há no fato apenas a constatação, fica ainda que circunstancialmente satisfeito, ainda mais prejudicado o Executivo em seus poderes, perante nossa Constituição Cidadã de ontem e de hoje, para o devir da mesma.

“Checks and Balances”

To some extent, my reflection this morning, watching Justice Luiz Fux’s vote, is that the system of “checks and balances,” famous throughout Western political science, is observed in Brazil, with the Legislature habitually acting as a Checks, and the Judiciary as a Balances. This further weakens the role of the Executive, where it has been argued historically in Brazil, which had a Constitution designed to be parliamentary in 1988, and became presidentialist by the sovereign will of the people. We always hear that the National Congress is extremely inconvenient and over-empowered in relation to the Executive. Understanding counterweights, with a rather curious observation, for example, the Courts of Auditors are annexed to the Legislature, the Public Prosecutor’s Office is also annexed to the Executive, and the Judiciary, if not annexed to anything, but with its Ministers appointed by the Executive, is truly the Balances. The fact is merely a finding, and even if circumstantially satisfied, the Executive branch is even more impaired in its powers, given our Citizen Constitution of yesterday and today, and for its future.
